Texas death row inmate Robert Roberson will testify in person before lawmakers in Austin on Monday.

Roberson’s execution was delayed after a Travis County judge issued a temporary restraining order. Roberson was scheduled to be executed by lethal injection Thursday evening, but the judge’s decision came just 90 minutes earlier, when a bipartisan group of lawmakers summoned Roberson to a hearing.

Roberson was convicted in 2002 of killing his then 2-year-old daughter, Nikki, based on testimony from experts on shaken baby syndrome. Roberson’s lawyers argue that his daughter died of pneumonia and that he should be protected by the state’s Junk Science Writ law, passed in 2013, which allows prisoners to challenge their convictions when new scientific evidence emerges. State lawmakers say they need to hear from Roberson about whether that law was ignored in his case.

Roberson will testify before the Texas House Criminal Jurisprudence Committee.
