Columbus man charged with open container – Peak of Ohio

On Wednesday evening, a Columbus man was charged with possession of an open container of alcohol after police responded to a report of erratic driving at a Marathon gas station on North Main Street.

Officers arrived at the scene after a caller alerted them to a red truck swerving onto the road.

The caller described the driver as being “all over the road” and nearly causing accidents before parking at the gas station.

Upon arrival, officers found 32-year-old Marcus Cobb of Columbus in a maroon truck equipped with a silver toolbox.

The vehicle was stationary and Cobb appeared visibly distressed, claiming he had had a “terrible” day.

When questioned, he stated that he was trying to get to County Road 9 but did not have a driver’s license.

Cobb admitted to drinking alcohol at the gas station earlier, but insisted he did not drink alcohol while driving.

Officers smelled alcohol and discovered an empty beer can in the vehicle.

Although Cobb appeared stable and did not exhibit slurred speech, he refused to submit to standard field sobriety tests on the grounds that he was not driving after drinking alcohol.

Officers issued a citation for the open container violation and explained the allegations to Cobb, who expressed concern about possible legal consequences.

Cobb’s passenger arrived at the scene and helped move his truck away from the gas pumps.

He was informed of his court date scheduled for next week.
