Following the Diarra ruling, FIFA will open a global dialogue on Article 17 of the Regulations on the Status and Transfer of Players

FIFA will open a global dialogue on the transfer system, involving key stakeholders, to adapt Article 17 of the Player Status and Transfer Regulations (RSTP). This announcement follows and is in line with the decision of the Court of Justice of the European Union in the Diarra case FIFA’s strategic goal is to further improve the transfer systemwhere significant progress has been made since 2016.

In the coming days, FIFA will formally invite stakeholders to submit comments and suggestions on Article 17 of the RSTP (“Consequences of termination of a contract without just cause”) in order to consolidate the proposals and determine the best way forward.

“FIFA looks forward to further developing its regulatory framework, of course taking into account the views and contributions of all relevant and affected parties,” said Emilio García Silvero, FIFA’s Chief Legal & Compliance Officer. “FIFA sees the Diarra decision as an opportunity to further modernize its regulatory framework, which has been one of the stated goals of the FIFA President since 2016.

“FIFA will now initiate a global dialogue with key stakeholders. Together with them, FIFA will determine what conclusions need to be drawn from the Diarra decision and what amendments to Article 17 of the RSTP are most appropriate and appropriate.”
