Lawyer for Bryan Malinowski’s family calls for accountability in deadly raid

State lawmakers held a hearing today on the role played by Arkansas law enforcement in the deadly raid on the home of Bryan Malinowski, the Little Rock airport executive who was shot and killed by federal agents as they investigated the sale of imported weapons without a license.

Major questions and concerns surround the authorities involved in this raid.

Bud Cummins, the Malinowski family’s attorney, says he wants to hold everyone involved accountable and continues to seek answers as to why Malinowski was killed in his own home.

“Brian Malinowski was an innocent man. He did not commit a crime and ATF had no evidence that he had committed a crime. The methods and tactics they chose were the most aggressive possible to execute a search warrant for what is probably the lowest alleged federal crime in the book.”

Cummins says there is no evidence to justify the dynamic entry into the home, which he describes as illegal. He says law enforcement could have taken other approaches to protect the lives of both officers and citizens.

“An Arkansan was killed in his own home. The federal government kicked down his door and killed him.”

He says Arkansans are concerned about what influenced the ATF’s decisions.

“The ATF apparently believes they can get into any home. But they’re wrong, there’s still a fourth amendment and they can’t do what they did, it’s illegal. And we hope to prove it. And hold them accountable.”
