The Texas Supreme Court decides to allow Roberson to testify on Monday

The Texas Supreme Court ruled late Sunday night that Texas death row inmate Robert Roberson will be allowed to testify on Monday, just days after his execution was stayed.

Texas Attorney General Ken Paxton sought to get the Supreme Court to overturn his decision before Monday’s testimony, arguing that suspending Roberson’s execution sets a bad precedent for the future.

“This is like a situation where the people who were involved in his case years ago are now telling the prosecution they made mistakes,” said Rep. Donna Howard.

Howard spoke before the TSC’s decision, calling Roberson’s circumstances monumental.

“There’s no reason why we shouldn’t review this and so I’m really amazed that it took so much effort to get this done, but again, I’m eternally grateful to my colleagues,” she said.

A bipartisan effort by Texas Democrats and Republicans persuaded the court to stay the execution for now, citing flawed evidence.

Roberson is on death row for the 2002 death of his 2-year-old daughter, citing shaken baby syndrome. If executed, he would be the first person in the country to be executed for a crime related to a diagnosis of shaken baby syndrome.
