Conviction of film gunsmith in fatal shooting on set of “Rust” by Alec Baldwin confirmed

  • A New Mexico judge has upheld gunsmith Hannah Gutierrez-Reed’s involuntary manslaughter conviction in connection with the fatal shooting of camerawoman Halyna Hutchins by Alec Baldwin on the set of the film “Rust.”
  • Gutierrez-Reed asked the court to vacate her conviction or order a new trial, alleging misconduct and suppression of evidence by law enforcement.
  • She was found guilty by a jury in March and sentenced to a maximum sentence of 18 months.

A New Mexico judge on Monday upheld a manslaughter conviction against a movie gunsmith in the fatal shooting of an Alec Baldwin cameraman on the set of the Western film “Rust.”

Gunsmith Hannah Gutierrez-Reed asked a court to overturn her involuntary manslaughter conviction or set a new trial in the shooting case because of law enforcement misconduct and suppression of evidence.

Judge Mary Marlowe Sommer halted and ended Baldwin’s trial in July due to police and prosecutors’ misconduct and withholding evidence from the defense related to the 2021 shooting of camerawoman Halyna Hutchins on set outside Santa Fe.

Gutierrez-Reed was convicted in March by a jury in a trial led by Marlowe Sommer, who later sentenced her to the maximum sentence of 18 months. Gutierrez-Reed’s involuntary manslaughter conviction is already pending appeal in a higher court.

Prosecutors accused Gutierrez-Reed of unintentionally bringing live ammunition to the set of “Rust” and failing to follow basic gun safety protocols.

Gutierrez-Reed’s lawyers argued that her case should be reconsidered because prosecutors failed to turn over evidence that might have been exculpatory.

She was acquitted at trial of allegations that she had tampered with evidence in the Rust investigation. Gutierrez-Reed also pleaded not guilty to a separate felony charge for allegedly carrying a gun into a bar in Santa Fe, New Mexico, where firearms are banned. A proposed plea agreement awaits judicial review.

Baldwin, the star and co-producer of “Rust,” was pointing a gun at Hutchins during a rehearsal for a film set outside Santa Fe in October 2021 when the revolver exploded, killing Hutchins and wounding director Joel Souza.
